Princess Cruises Terms and Conditions

Important cruise information

BROCHURE PRICES

The prices for all holidays in this brochure apply to bookings made more than 6 weeks before departure since Princess Cruises have allocations of air seats and hotel rooms which may not be available at these prices within 6 weeks of departure. For bookings made within 6 weeks of departure Princess Cruises may need to renegotiate air and hotel costs.

Additionally, demand for air seats and hotel rooms at peak travelling periods which exceed Princess Cruises allocations may also require Princess Cruises to renegotiate your fare.

We arrange allocations of economy flights for our cruises, where applicable, with our partner airlines at a special fare and in a specific economy fare class. Once this allocation has been sold we may still be able to book your flight but we may have to charge you an additional flight supplement.

Should there be any increase in fares you will be informed before booking. The fares shown in this brochure apply to bookings for residents of the UK and Eire only. Prices in this brochure are quoted in pounds sterling and are valid from 1 December 2007. We reserve the right to vary particulars and prices shown in this brochure after the date of publication. Prices, discounts, supplements and special offers advertised in this brochure or elsewhere may be withdrawn or changed. Prices may go up or down. The basic price excludes any fuel supplement charge which may be added to it. Prices may rise in subsequent editions of this brochure. Regular promotions and discounts from both ourselves and travel agents mean that savings on the brochure prices are available from time to time, which will vary depending on when the booking is made and the popularity of the dates and itinerary of a particular cruise/holiday and other factors. Please contact your travel agent for up to date prices and charges before you book, or call us on 0845 3 555 800. CHILD AND INFANT FARES On selected Sea Princess cruises – as indicated on the individual cruise pages – Princess Cruises offers discounted fares for children, subject to availability, which apply to children aged from 2 years to 16 years inclusive at the time of the cruise, and infants under the age of 2.

On all other cruises – as indicated on the individual cruise pages – Princess Cruises offers ‘Family Fun Fares’ (see fare tables for specific fares), which apply to children from 6 months to 11 years inclusive. Children must be within this age range on the sailing date. ‘Family Fun Fares’ and free and discounted

child places apply only to children occupying a 3rd or 4th bed when the appropriate adult fare for that stateroom has been paid.

GUARANTEES

When you or your travel agent come to make a reservation you may be offered the guarantee of a cabin grade, rather than a specific cabin number. This is because we know from past experience that a small number of passengers will unfortunately be forced to cancel their arrangements, thus leaving the accommodation vacant. Accepting a guarantee means that you have a firm booking and can go ahead with your holiday plans in the same way as if you had accepted a specific cabin number at the outset. When we allocate a cabin number you can rest assured you will be given a cabin of the type you have booked, or, in some instances, of a higher rate, though it may be situated on a different deck to that shown on the deck plan for the grade guaranteed. The fare you have been quoted will remain unchanged.

TICKETS AND FURTHER INFORMATION

Once you have made your initial booking, we will send you a deposit confirmation. A comprehensive information booklet, including tipping guidelines, will be sent to you 8-10 weeks before departure. Once you have paid the balance of your fare we’ll mail you your tickets together with embarkation details and luggage labels, to arrive approximately 2-3 weeks before departure.

SPECIAL OCCASIONS & RENEWAL OF VOWS

A number of Special Occasions and Renewal of Vows packages are available for booking prior to your cruise. These include a variety of pampering treats such as champagne breakfast in bed, spa visits, canapes in your stateroom and framed formal portraits. Packages start from £94 per couple, and full details will be sent to you in your information booklet 8-10 weeks before departure.

PARKING IN SOUTHAMPTON

If you're sailing roundtrip from Southampton car park facilities are available, subject to availability and additional costs. These arrangements are at the discretion of Princess Cruises.

COACH CONNECTIONS

Eavesway Travel operate a cruise link service to/from Southampton on cruise nos. C810-C820, A821, A823 and A825, subject to availability.

FLIGHTS

Economy class air travel is included in the fare for all cruises not sailing roundtrip from Southampton. Princess Cruises will arrange flights with reputable scheduled or charter carriers such as British Airways, SAS, Lufthansa, Thomas Cook Airlines and Thomsonfly. Full details of air travel arrangements will be notified to you once finalised. Premium Economy, Business and First Class supplements are available on request, depending on airline and destination.

Upgrades are subject to availability and prices are subject to change from the time of quoting until final payment has been made. Air Departure Tax may be charged in some countries. This is not included in the cruise fare and is the responsibility of the passenger. This tax is collected at the airport and may have to be paid in local currency.

All Flights – Please Note:

1 Princess Cruises reserves the right to determine the hotels, airports, air carriers and flight routings used for all holidays in this brochure.

2 Amendments or cancellations to flight arrangements can usually be made prior to 90 days before travel, subject to an administration fee of up to £50 per booking. After this time, amendments or cancellations to flight arrangements may still be possible, subject to an administration fee of up to £50 per booking plus any charges imposed by the airline(s).

3 Airlines reserve the right to refuse travel on medical grounds. You must notify us of any medical conditions or other requirements for airport assistance (only available after check-in) or special arrangements on your flight. You may be required to provide additional information to the airline in order that they can assess your fitness to fly. Please note that several airlines are unable to carry passengers who require oxygen during part or all of the flight. Those that do require advance arrangements to be made at additional cost.

4 If you have any special dietary requirements including child meal requests, please advise us at the time of booking or at least 7 days prior to travel. We are unable to guarantee that all requests can be met.

5 Only fully fit and able-bodied passengers may occupy exit row seats. These seats may therefore only ever be assigned at the discretion of the airline at Check-in.

6 Due to the configuration of the aircraft, it may not always be possible to obtain seats together. Princess Cruises has no control over the allocation of airline seats and cannot guarantee seat requests.

7 Baggage allowances vary by destination and airline and may not always be the same for all parts of your itinerary. Please note that it is the airlines that govern baggage allowance.

8 All flights are non-smoking.

9 Air carriers and flight routings are subject to change and will not necessarily be direct or non-stop. 10 Passengers flying from/to or via London may need to transfer between Heathrow and Gatwick or vice versa depending on flight allocations held by Princess Cruises. In these cases, Speedlink coach transfers will be provided upon request.

11 Where a choice of UK departure airports is offered, this is subject to availability.

12 Due to disembarkation and flight arrival times, hotel rooms may not be available on arrival. Hotel check-in times vary, but are generally between 1pm and 5pm.

HEADSTART PACKAGE

Princess Cruises can arrange regional flights from/to a range of UK airports, and/or an overnight hotel stay at the departure airport of your international flight, please see table on page 50 for full details.

Regional Flights – Please Note:

a. Regional flights are offered subject to availability. Depending on flight schedules, overnight hotel accommodation may be required. Should subsequent schedule changes result in no regional air service being available from a particular airport, no alternative transport will be provided.

b. Where no regional air service is available to London, no alternative connection will be provided. c. Unless otherwise specified, the best available connection between your domestic and international flights will be booked at the discretion of Princess Cruises.

d. Connection times between international flights and domestic services to/from some UK airports can occasionally be longer than ideally required, especially at weekends when services are less frequent. If your outward or return regional flight does not have a same day connection with your international flight, we will arrange the most appropriate alternative. Should an overnight hotel stay be required, this will be booked at your expense.

e. As noted under ‘Brochure Prices’ above, all flight prices given for regional flights exclude any fuel supplement charge which may be added. We reserve the right to increase the price of regional flights shown in the brochure after publication, so please check before you book.

f. Reductions are not available for children, or for one-way travel. UK Hotel Stays – Please Note:

a. UK hotel stays are offered subject to availability and cannot be booked within 7 days of departure.

b. Should you need to cancel your hotel reservation, please advise us as soon as possible. Refunds are not available for cancellations within 7 days of your stay.

c. At London Heathrow, to transfer between the hotel and the airport terminals passengers will need to use either a taxi or the Heathrow Hoppa Bus Service, which is available at a small cost. Tickets may be purchased at the hotel or at the Speedlink desks in the terminals.

DO I NEED A PASSPORT OR VISA?

If you are a British Citizen, a full passport is required for all the holidays in this brochure. If you DO NOT HOLD A BRITISH CITIZEN PASSPORT, your travel documentation and visa requirements may be different. You should check with your travel agent or Princess Cruises to ensure you have the correct  documentation. The following passport and visa information is for British Citizens only. You will need to have 6 months validity in your passport after your date of return. If you need a new passport you should apply in good time prior to your departure. Please note British Visitor Passports are no longer valid. British Subject passport holders requirements may differ, please ensure you obtain the necessary documentation. At the time of going to press no visas were required for holders of British Citizen passports for any of the cruises featured in this brochure. Passengers travelling to Europe on non British Citizen passports and not members of the Schengen States should check with their travel agent or Princess Cruises for information on how to apply for a Schengen Visa. The Schengen member states are: France, Austria, Germany, Luxembourg, Netherlands, Belgium, Italy, Spain, Portugal, Greece, Denmark, Sweden, Finland, Norway and Iceland. If you should need advice on visa requirements please contact the Princess Cruises visa information department on 0845 0710308. Please be aware that passengers applying for their first passports may now be required to attend interviews prior to their passports being issued. For this reason, we would advise all passengers in this situation to allow a minimum of 6 weeks to obtain their passports.

VISAS – United States of America

If you are travelling on cruise nos. C820-C823, you will need to ensure that you comply with all conditions of the US Visa Waiver Programme. If you are uncertain please contact the US Embassy on 090 4245 0100 (premium call rate) or online at www.usembassy.org.uk or contact Princess Cruises Visa Information department on 0845 071 0308. St Petersburg, Russia. For cruises calling at Russia, we expect to be able to arrange block visas for passengers travelling on organized shore excursions, however, if this is not possible we will advise you in good time to obtain a visa yourself. If you intend to go ashore independently in St Petersburg, a Russian Tourist Visa is required. This MUST be obtained before leaving home as visas cannot be granted during the cruise. Should you wish to obtain an individual Russian Tourist Visa, you will need to be sponsored by a licensed Russian Tour company. This company will provide you with the necessary documentation to obtain your individual Tourist Visa. After obtaining this information, you will need to contact a visa service or the Russian Embassy at www.russialink.org.uk for the visa.

FARES

Princess Pricebreaker – save up to 45% on bookings made before 28 February 2008. All cruises qualify for up to a 45% Pricebreaker discount, subject to the following conditions: We have set aside staterooms at selected grades on all cruises and these are available with the Pricebreaker discount. Once these staterooms have been sold, the fare may revert either to a lower discounted fare or to the full brochure fare and we reserve the right to do this at any time. These Princess Pricebreakers are subject to availability and it is therefore advisable to book early. Discounts apply only to the full brochure fare. Discounts do not apply to children’s fares. For one passenger occupying twin stateroom accommodation on an exclusive occupancy basis the single supplement should be added to the pricebreaker fare shown. This offer is subject to availability, and may be changed or withdrawn at any time. Princess Pricebreakers constitutes a promotional offer and cannot be combined with any other promotional offer from Princess Cruises. Princess Pricebreakers do not apply to landtours, supplements for flight upgrades, stopovers or domestic flights, Headstart packages, special occasion packages, insurance or to the changes made to published itineraries such as cruise only. We reserve the right to withdraw Princess Pricebreaker discounts from specific grades and/or from entire cruises at any time. PAYING YOUR BALANCE OF FARE

After you have made your booking, a confirmation will be sent to you showing the deposit you have paid and invoicing the balance of fare outstanding.

Princess Cruises must receive the balance of your fare no later than 56 days before departure. If it is not received by the due date, Princess Cruises reserves the right to end the contract between us and re-sell the accommodation held for you, which will also result in the forfeiture of your deposit. www.princesscruises.co.uk 63 You must bring a photocopy of the photograph/personal details page of your passport if you are intending to go ashore with an organised excursion or independently. Estonia. Estonia has recently introduced new visa requirements. All British Citizen passport holders will be able to enter Estonia without a visa. If you are not in possession of a British Citizen passport, please ensure you check your entry requirements for Estonia at www.vm.ee/eng/kat_150/ Should you wish to stay onboard the ship during the call at Estonia, you will not require a visa.Norway. Passengers holding British Citizen passports do not require any visas for entry into Norway. However, revised visa regulations have been recently published for entry into Norway. If you hold a non-British Citizen passport, you may require a visa to enter Norway and this must be obtained prior to your cruise. You can check your visa requirements for Norway by visiting the www.norway.org.uk/visas/ You will not be able to embark the ship without the correct travel documentation. Canada. All British Citizen passport holders will be able to enter Canada without a visa. If you are not in possession of a British Citizen passport, please ensure you check your entry requirements for Canada at www.cic.gc.ca/english/visit/visas.html This will provide you with an up to date list of passport holders that require a Temporary Resident Visa (TRV) for Canada. British Subject passport holders are likely to require a Temporary Resident Visa (TRV). It is your responsibility to check your TRV requirements.

IN THE EVENT OF A DELAY

Delays to ships and flights are rare, but do occasionally occur. In such situations Princess Cruises, in conjunction with its suppliers as appropriate, will use its best efforts to ensure the comfort of its passengers. Depending on the circumstances this may include light refreshment, meals and accommodation, but this will always be governed by facilities and services locally available. Princess Cruises’ aim will always be to minimise the inconvenience of any delays. Additionally most travel insurance policies contain cover for delayed departure.

CRUISE ONLY REDUCTION

This applies when passengers do not take flights, transfer and hotels featured as part of the brochured holiday. The Cruise Only Reduction for children (under 12) is 50% of the adult Cruise Only Reduction. Where hotel arrangements are not taken or passengers fly out earlier than their hotel stay, transfers to the ship are not included.

DISEMBARKATION ARRANGEMENTS

Depending on flight schedules, Princess Cruises in its discretion will arrange either a transfer to the airport for your homeward flight, use of facilities at a first class hotel or a local sightseeing tour as appropriate. The disembarkation arrangements set out in the brochure itineraries will be operated should the flight schedules require them. These arrangements are at Princess Cruises’ discretion and may be subject to change.

TRAVEL ADVICE UNIT

The Foreign and Commonwealth Travel Advice Unit may have issued information about your holiday destination. You are advised to check this information on BBC2 (Ceefax) page 470 onwards, or on the Internet under the address www.fco.gov.uk Alternatively, you can contact the ABTA Information Department on 0901 201 5050 (calls charged at 50p per minute).

HEALTH CONSIDERATIONS

All Princess Cruises ships carry qualified Medical and Nursing staff. As ships are outside the scope of the National Health Service, charges will be made for all medical services, although in most cases these charges will be claimable under your travel insurance, after deduction of any excess.

VACCINATIONS

There are no mandatory vaccinations for the cruises in this brochure, however The Department of Health does recommend vaccinations for certain countries visited on our cruises. Since these recommendations changecontinuously, you should check in good time before departure with your GP, or ask your travel agent for a copy of the Department of Health’s leaflet, “Advice on Health for Travellers” or telephone MASTA (Medical Advisory Service to Travellers Abroad) on (0906 550 1402) at £1 per minute, or visit www.masta.org ARE YOU FIT AND WELL?

For your own sake - and for the comfort of other passengers – you must be fit and healthy to travel with us. Naturally there is a well equipped Medical  Centre on every Princess Cruises ship, but our medical facilities aren’t designed for extensive or continuing treatment of pre-existing conditions. So if you have a medical condition that necessitates the use of oxygen, or you will be taking any medical equipment with you such as a nebuliser, CPAP machine or oxygen concentrator or if you need to dispose of medical sharps or require peritoneal dialysis you must inform us at the time of booking. For the safety and comfort of all passengers we are unable to carry any passengers suffering from a contagious disease (eg. measles, chicken pox etc.). Also passengers who normally require assistance in the activities of daily living are advised that a companion fit and able to assist them must accompany them. Please note that if health conditions as disclosed at the time of booking change, Princess Cruises must be notified immediately. All of our Medical Centres hold the distinction of being the first and only facilities in the industry to be accredited by the prestigious United Kingdom Health Quality Services and certified to ISO9001:2000.

MOBILITY

Please notify Princess Cruises, at the time of booking, in writing, of any physical or mental illness or disability. Also, if you require any medical treatment or you have a condition that may constitute a risk or danger to you or anyone else on board ship please let our Medical Department know. If you have a condition that requires special accommodation or you need to bring a wheelchair, power wheelchair or mobility scooter (referred to collectively in this section as wheelchairs) please notify our Reservation Department as soon as possible or at time of booking. We advise passengers using a wheelchair to travel with someone who is able to assist them both ashore and at sea. Some ports of call require tenders to go ashore and may preclude passengers using a wheelchair from leaving the vessel, this decision must be made by the ship’s Captain and is binding. Passengers must bring wheelchairs for their own use. A limited number of manual wheelchairs can be reserved up to 7 days prior to embarkation. MUMS-TO-BE We regret that we cannot carry passengers who have entered their 24th week of pregnancy or beyond at any point during their cruise.

SPECIAL DIETS

We are happy to meet your request for low-sodium, low-fat and vegetarian diets. In addition, kosher meals (frozen entrées only) and baby food are available upon written request. Please ask your travel agent to advise Princess Cruises in writing of any requests for special diets to accommodate medical needs or allergies at time of booking or no less than six weeks before you sail. Please note that baby formula is not available once on board. Please check with the Maitre d’Hotel when you board to confirm your request.

AMENDMENTS

You may (subject to availability) change to another holiday advertised within this brochure if the request is made more than 56 days before departure and an administration fee of £100 and any costs (including those levied by airlines and/or hotels) incurred by Princess Cruises as a result are paid. If you require a change of holiday 56 days or less before the departure date, this shall be treated as a cancellation of the original booking If you change holiday, a new fare will apply and any discount you may have received at the time of the original booking may not apply to the new booking.

Once a holiday is booked, Princess Cruises will try to accommodate any requested amendments to that holiday (e.g change of cabin), although such changes are at Princess Cruises’ discretion and are subject to an administrative fee of £20. Where one passenger travelling in a twin room cancels, but a companion sharing that cabin wishes to continue to travel, Princess Cruises will reassess the fare on a single occupancy basis.

I'M A BIT UNCLEAR ABOUT TIPPING...

During your cruise, you will meet many members of our staff in a variety of locations as they provide you with excellent service. Additionally, many more crew behind the scenes support those who serve you directly. For your convenience a discretionary Hotel and Dining charge of $11 per passenger per day (including children) for those staying in suites and mini suites, and $10.50 per passenger per day (including children) for all other staterooms will be automatically added to your shipboard account on a daily basis. The Hotel and Dining charge will be shared amongst those staff who help provide and support your cruise experience, including the wait staff, stateroom stewards and housekeeping staff, buffet stewards, food production staff, and others. Should you wish to make any adjustments to it, you may do so by contacting the Passenger Services Desk onboard. (Casino dealers and Lotus Spa personnel do not share in the Hotel and Dining charge as not all passengers utilise these services). In addition, a 15% charge is automatically added to your bar charges and dining room wine account. This is shared amongst the beverage staff and their support staff, including cleaners and utility staff.

CHILDREN’S FACILITIES

Royal Princess and Pacific Princess do not have a dedicated Youth and Teen Centre. However when 20 or more children aged 3 to 17 are travelling onboard Royal Princess and Pacific Princess they will enjoy a varied schedule of supervised activities organised by a Youth Activities Coordinator. All other ships in this brochure feature a Youth Centre and a Teen Centre. Staff will supervise children from the ages of 3-17 in a variety of activities to keep them entertained. The centres are open during days at sea from 9am-noon, 2-5pm and 7pm-10pm. Group babysitting is available from 10pm-1am for 3-12 year olds at $5 per hour, per child. While the ship is in port, babysitting or supervised activities are offered from 8am-5pm for 3-17 year olds at no charge. Please note that you are advised to book early if taking children as only a limited number of children can be accommodated on each individual cruise. Please note that: nappies cannot always be purchased on board and Youth Co-ordinators will not change nappies, bottle feed or administer medication. A complimentary lunch is provided on in-port days. Supervised pool times are only as advertised in the daily programme - adult supervision is required at other times. Please note that private babysitting is not available on any Princess Cruises ship. Regardless of the itinerary, the minimum age for children to participate in supervised activities is 3 years. Children under 3 years old are welcome in the Youth Centre but must be accompanied and supervised by a parent or guardian at all times during their stay (numbers permitting). AGE LIMITS

Due to the Princess Cruises fleet operating under US legislation, passengers must be 21 years or age or over to purchase or drink alcohol or gamble (18 years or over on Sea Princess cruises departing from Southampton) and Princess Cruises reserves the right to request proof of age. Passengers under 18 are not permitted in the disco/nightclub. Children under 6 months are not permitted to travel on Princess ships. On cruise no. C820 the minimum age permitted to travel is one year old.

SMOKING ARRANGEMENTS

To ensure that all our passengers feel comfortable while on board, we have adopted the following smoking policy. Smoking is NOT permitted in the restaurants, main show lounges or theatres. However, smoking IS permitted in designated areas in other public rooms and in yourstateroom. We ask all passengers to refrain from smoking cigars and pipes anywhere indoors, although this is permitted on the outer decks. Please note that at the time of going to press the new UK legislation banning smoking in public spaces had recently come into effect (1 July 2007). The implications of the new law for the passenger shipping industry will not become fully clear until detailed regulations for this sector are published, however it may impact on our ships when in UK waters or ports. We will make sure that passengers are clearly informed of the policy as it stands whilst they are travelling with us.

RESPONSIBILITY

This brochure is issued on the sole responsibility of Princess Cruises. It is not issued on behalf of and does not commit the airlines mentioned therein or any airline whose services are used in the course of Fly/Cruise holidays.

CHANGES TO INFORMATION

The information in this brochure represents Princess Cruises’ plans and intentions at the time of going to press. Events subsequent to the printing of the brochure may cause us unavoidably to change our plans, which could affect the published itineraries and/or the prices and port taxes. In the event of significant changes or alterations you will be told promptly where we wish to increase the cost of the holiday we will comply with the applicable law on surcharging as set out in clause 23 of our booking conditions on pages 64 and 65. Conditions of the airlines and tour operators participating in Fly Cruises may be obtained on request.

YOUR DEPOSIT

Prior to 56 days before departure, we require 10% of the total fare per person as a deposit which is not refundable but which will count towards the balance due for your holiday. Your holiday insurance, if effective from the time of booking your cruise holiday, should protect you against loss of deposit in the event of cancellation, subject to the policy terms and conditions. For bookings made within 56 days of departure, full payment is required straight away.

PHOTOGRAPHY

The photography used throughout this brochure depicts typical locations and scenes that may be viewed on a Princess Cruise. Any imagery used may not be a specific representation of what can be seen on that cruise, but may simply reflect the ambiance or theme of a location visited. Booking conditions These are the terms and conditions which will apply to your holiday. Please read them carefully as you will be bound by them.

DEFINITIONS

1. In these Conditions and unless the context requires otherwise: “the Contract” means the contract made between Princess Cruises and the Passenger relating to the cruise; “cruise” means the cruise holiday as described in the relevant Princess Cruises brochure or other documentation published by or on behalf of Princess Cruises, including any flights to and from the UK and any pre-cruise and/or postcruise package, but not including shore excursions or shuttle services; “force majeure” means unusual and unforeseeable circumstances beyond the control of Princess Cruises that Princess Cruises cannot, even with the exercise of reasonable skill and care, provide the cruise, or part thereof, including any part of the itinerary, and includes (without limitation) war or threat of war, terrorist activity or the threat of terrorist activity, riots, civil commotion, disaster, Act of God, natural and nuclear disaster, fire, closure of ports, strikes or other industrial action, medical problems on board the ship or at intended ports, including, in each case, incidents of infectious or other diseases or illnesses, lawful deviation at sea in response to a distress call or other emergency and adverse weather conditions; “itinerary” means the proposed itinerary as described in the relevant Princess Cruises brochure or other documentation published by or on behalf of Princess Cruises; “the Passenger” means each and every person named in the booking and/or a Princess Cruises ticket; “Princess Cruises” means Carnival plc trading as Princess Cruises. Princess ships are operated by Princess Cruise Lines Limited, a Bermudan Company, save for Sea Princess which is operated by Carnival plc North American branch. In the case of carriage by air Princess Cruises is licensed by the Civil Aviation Authority under ATOL 6294; “the price” means the price for the cruise (excluding shore excursions and any additional charges shown as such in the relevant Princess Cruises brochure or otherwise advertised) applicable at the time of booking and payable by the Passenger under the Contract; “shore excursion” means any excursion offered for sale by Princess Cruises on board for which a separate charge is payable at the time outside the all-inclusive price whether booked in the UK prior to the commencement of the cruise or on board the cruise ship; “shuttle service” means any transportation service (ferry, bus, coach or minibus) provided by a third party which may (without guarantee) be available to Princess Cruises’ passengers in certain ports; “a significant alteration” means major changes to your cruise; “Supplier(s)” means any company or individual which provides any service forming part of the cruise.

THE CONTRACT

2. The Contract shall be between Princess Cruises and the Passenger on the basis of these Conditions and the information contained in the brochure. The Contract will be governed by English law and the non-exclusive jurisdiction of the English courts. By entering into the Contract, Princess Cruises agrees to exercise reasonable skill and care to provide the cruise.

3. By making a booking, the Passenger confirms that all persons named in the booking (and their personal representatives) have agreed to be bound by these Conditions and all other terms of the Contract, and that he/she has their authority to do so on their behalf.

4. All cruises are subject to availability at the time of booking. No Contract shall be made until the deposit (or, where appropriate, the full price) has been paid, whether or not a booking confirmation has been issued, but all money paid to a travel agent shall be treated as having been paid to Princess Cruises. Failure to pay the balance by the due date shall entitle Princess Cruises to cancel the booking and retain the deposit by way of a cancellation charge. Failure to pay any other amount by the due date shall entitle Princess Cruises to cancel the booking and to retain an amount by way of a cancellation charge as set out in clause 25.

5. A booking may only be made by a person aged 21 or over. All Passengers who, at the time of departure, will be under 21 years of age must be accompanied by a Passenger aged 21 or over who will at all times during the cruise be responsible for their welfare, conduct and behaviour.

6. Children aged 6 months or less at the commencement of the cruise will be refused permission to board the cruise ship and Princess Cruises shall have no liability whatsoever for any consequences of such refusal. Certain cruises also have prohibitions on children aged 12 months or less. Passengers should check with Princess Cruises before booking.

7. Princess Cruises does not have on board its cruise ships adequate medical facilities for childbirth. We regret that we cannot carry passengers who have entered their 24th week of pregnancy or beyond at any point during the cruise. In the case of a booking by or on behalf of any such Passenger made before it could reasonably have been known that the Passenger would not be able to join the cruise by reason of this clause, Princess Cruises will refund in full the price paid by or on behalf of that Passenger and the price paid by any accompanying Passenger but shall otherwise have no liability whatsoever. Princess Cruises expressly reserves the right to refuse passage on board to any Passenger who appears to be in an advanced state of pregnancy and Princess Cruises shall have no liability whatsoever in respect of either such refusal and/or the carriage of any such Passenger.

8. Princess Cruises reserves the right to require any Passenger to produce medical evidence of fitness to travel on the cruise.

9. Passengers must notify Princess Cruises in writing (Attention: Reservations) at the time of booking of any physical or mental illness, disability or other condition for which special accommodation or the use of a wheelchair, power wheelchair or scooter is contemplated or necessary, or which may require medical treatment or render the passenger unfit to travel or which may constitute a risk or danger to the passenger or anyone else on board the ship. Princess Cruises advises Passengers using a wheelchair to travel with someone who is able to assist them both ashore and at sea. Some ports of call require tenders to go ashore and may preclude passengers using a wheelchair from leaving the vessel. A decision made by the ship’s Captain on this is binding. Passengers must bring their own wheelchairs although a limited number of manual wheelchairs can be reserved up to 7 days prior to departure, for use during the cruise and on shore excursions that have been approved for disabled travel.

10. A Passenger shall not have the right to exclusive occupancy of a cabin with two or more berths unless the single person surcharge is paid. If a cancellation results in a Passenger becoming the sole occupant of a cabin with two or more berths, he/she shall be liable to pay the single person surcharge. If a cancellation reduces the number of Passengers originally booked in a cabin together, the remaining Passengers shall each be liable to pay any increase in the price arising as the result of such reduction.

11. For fly cruises (and if not already confirmed at the time of booking), Princess Cruises will issue an ATOL confirmation invoice giving the details of the flight arrangements (including UK and destination airports) within a reasonable time after such arrangements are known.

12. Shore excursions are available for separate purchase on board and are arranged by Princess Cruises with local operators. They do not form part of the Contract.

AMENDMENTS TO THE CONTRACT

13. In clauses 13 and 14, “another person” means another person who satisfies all conditions applicable to the cruise. A booking may be transferred to another person provided that Princess Cruises receives the transfer request more than 56 days before the scheduled departure date. Between 56 and 14 days (inclusive) before the scheduled departure date, Princess Cruises will normally agree to such a transfer only where the original Passenger will be prevented from travelling by reason of an unavoidable event (such as illness, death of a close relative or jury service) and Princess Cruises may require satisfactory evidence before agreeing to the transfer. All transfers of a booking to another person at any time up to 14 days or more before the scheduled departure date will be subject to an administration charge of £20.

14. Any request for a transfer of a booking to another person which is received by Princess Cruises 13 days or less before the scheduled departure date shall be treated as a cancellation by the Passenger of the original booking and a cancellation charge under clause 25 shall become payable.

15. Any transfer of a fly cruise will also be subject to any charges imposed by the airline. Passengers should note that airlines may not allow transfers on scheduled flights and that a flight booking may have to be cancelled and rebooked, in which event the re-booking will always be subject to flight availability and to payment of any charges imposed by the airline which may, in some cases, be the full cost of the ticket.

16. Subject always to availability and to payment of both an administration charge of £100 and any expenses (such as airline and/or hotel charges) incurred by Princess Cruises as a result, a Passenger may, at Princess Cruises’ discretion, transfer to another cruise advertised in the brochure which is for a similar duration and price at any time up to 56 days before the original scheduled departure date. After that time, any such transfer will be treated as a cancellation by the Passenger and a cancellation charge under clause 25 shall become payable.

17. All such transfers to another cruise will be treated as a new booking. Any discount applicable to the original booking may not apply to the new booking, in which case the Passenger shall be required to pay any difference in price.

18. After a cruise has been booked, Princess Cruises will try to accommodate any request for a change (such as a change of cabin), but such changes are always at Princess Cruises’ discretion and are subject to an administration charge of £20.

INSURANCE

19. It is a condition of the Contract that every Passenger must have travel insurance in force for the entire duration of the cruise. Details of the insurance policy (which must as a minimum include medical and repatriation coverage for not less than £2 million) must be provided at the time of booking or as soon as practicable thereafter.

20. Wherever possible, Princess Cruises will offer general assistance to any Passenger who suffers illness, personal injury or death during the period of the cruise, whether or not arising from an activity forming part of the cruise and whether or not the result of fault by any party.

21. Any cost or expense which is reasonably incurred by Princess Cruises for or on behalf of the Passenger in respect of any form of medical, dental or similar treatment, hotel, transportation, repatriation or any other expense shall be repayable by the Passenger to Princess Cruises, whether or not such sum is covered by the Passenger’s travel insurance.

PRICES AND EXTRAS

22. All prices are based on costs and exchange rates as at 1 December 2007. Princess Cruises reserves the right to vary particulars and prices shown in this brochure after the date of publication. Prices, discounts, supplements and special offers advertised in this brochure or elsewhere may be withdrawn or changed. Prices may go up or down. The basic price excludes any fuel supplement charge which may be added to it. 23. The price can be varied due to changes in transportation costs such as fuel, scheduled air fares and other airline cost changes which are part of the contract between airlines (and their agents) and Princess Cruises. Also government action such as changes in VAT or any other government imposed changes and currency changes in relation to an exchange rate variation. In the case of any small variation, an amount equivalent to 2 per cent of the price of your travel arrangements, which excludes insurance premiums and any amendment charges, will be absorbed or retained. For larger variations this 2 per cent will till be absorbed for increases but not retained from refunds. In either case there will be an administration charge of £1 per Passenger, together with an amount to cover agents’ commission. If this means that the Passenger has to pay an increase of more than 10 per cent of the price of the cruise, the Passenger may cancel the cruise and receive a full refund of all monies paid, except for any amendment charges. Princess Cruises will consider an appropriate refund of insurance premiums paid if the Passenger can show that he/she was unable to transfer or re-use the policy. Should the Passenger decide to cancel for this reason, the Passenger must exercise his/her right to do so within 14 days from the issue date printed on the final invoice. Alternatively, the Passenger can accept an offer of an alternative cruise if Princess Cruises are able to provide an alternative and transfer payment made in respect of the original cruise to the alternative cruise. If the cost of the alternative cruise is less than the original cruise the difference in price will be refundable. Princess Cruises will also pay compensation as set out in clause 27 below. Please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your cruise due to contractual and other protection in place.

24. All accounts for on-board services and goods and for shore excursions must be settled in full before the Passenger leaves the cruise ship. In the event that a Passenger fails to settle his on-board account at or before the completion of the cruise, Princess Cruises shall be entitled to make a reasonable administration charge for the subsequent collection of such sum due in addition to any costs of legal process.

CANCELLATION BY THE PASSENGER

25. The Passenger may cancel the Contract at any time prior to the commencement of the cruise by giving notice in writing to Reservations Department, Princess Cruises, Richmond House, Terminus Terrace, Southampton SO14 3PN (fax number 023 80657030), but in that event Princess Cruises shall be entitled to levy a cancellation charge as a percentage of the fare paid in accordance with the following scales.It may be possible for the Passenger to re-claim these cancellation charges (less any applicable excess) under the terms of the Passenger’s insurance policy. Claims should be submitted to the appropriate insurer. After departure, if the Passenger disembarks whether by reason of sickness or any other reason the Passenger will not be entitled to a refund of a proportion of the cruise not used.

ALTERATION AND CANCELLATION BY PRINCESS CRUISES PRIOR

TO DEPARTURE

26. Whilst Princess Cruises will do its best not to cancel or to make any significant alteration after a booking has been made, it shall nevertheless be entitled at any time prior to departure to cancel the Contract or to change and/or curtail the itinerary where this reasonably becomes necessary on operational, commercial or other grounds. Princess Cruises will inform the Passenger of any such cancellation or change of itinerary as quickly as possible (with, where appropriate, written confirmation as soon as reasonably possible thereafter). If Princess Cruises makes a significant alteration to the cruise it will inform the Passenger or his travel agent as soon as reasonably possible. The Passenger will have the choice of either accepting the alteration, accepting an offer of an alternative cruise of comparable standard if available (Princess Cruises will refund any price difference if the alternative is of a lower value) or cancelling the cruise and receiving a full refund of all monies paid. The Passenger recognises and agrees that it will not normally be possible for Princess Cruises to offer an appropriate substitute cruise which is available at about the same time as and/or with a similar itinerary to that originally booked, but Princess Cruises will do its best to provide a suitable alternative cruise of similar duration and value. The Passenger must notify Princess Cruises of his decision as soon as reasonably possible and in any event not later than 14 days of being informed of the significant alteration.

27. If the Passenger cancels the holiday in the circumstances set out in clause 26 or if Princess Cruises cancels the cruise, the Passenger shall also be entitled to compensation as follows (except if the change or cancellation is due to force majeure, non-payment by the Passenger or where the minimum number of Passengers required for a holiday to proceed is not reached).The value of any cruise credit will be calculated by reference to the price actually paid for the cancelled cruise and may only be used for other bookings with Princess Cruises. Any such new booking must be made by no later than 31 December of the year after the date of the original cruise. Credit vouchers may be redeemed against the price of the new cruise net of any discount available to the Passenger at the time of booking. The compensation set out above does not exclude the Passenger from claiming more if he/she is entitled to do so or from requesting that compensation be provided in a different form.
